FeelyTalk is an internet-based mobile phone application owned and operated by M/s Feel Connected Private Limited. Throughout this document, the terms “we”, “FeelyTalk”, and “M/s Feel Connected Private Limited” are used interchangeably, while “you” and “users” refer to the individuals who use our services. The term “we” also covers our employees, officers, directors, agents, successors, assigns, parents, subsidiaries, divisions, and affiliated corporations, as applicable.

FeelyTalk is committed to protecting the privacy of its users, emphasizing the utmost care in maintaining the confidentiality of your personal information. Our approach to data security and privacy ensures a no-leak and no-disclosure policy. Users and Listeners on our platform have complete control over the information they choose to share.

    Any information shared during sessions with Listeners is redacted, censored, and obscured to maintain confidentiality. FeelyTalk employees and external Listeners cannot access or view this data.
  • Promotional Communication:
    We send promotional messages only with your permission, and you can opt-out anytime.
  • No Third-Party Sharing:
    Your data is never sold, rented, or shared with third parties unless required for delivering the services you’ve opted for.

Personalized Experience

FeelyTalk may use the basic data you provide to enhance your user experience. However, this is always done with your implied consent.

Data Storage and Security

All user data is stored securely, adhering to strict encryption standards. We do not collect or store any sensitive personal data and actively encourage users not to share such information.

Responsibilities and Liabilities

FeelyTalk acts as an intermediary as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. As an intermediary:

  • FeelyTalk does not edit, modify, or manipulate user-generated content.
  • We are not liable for the actions or disclosures of any party using the platform, including users or Listeners.

Confidentiality Agreements

FeelyTalk ensures that Listeners are bound by strict confidentiality agreements and non-disclosure contracts.

Legal Disclosures

FeelyTalk may disclose user information to government authorities only under valid court orders or in compliance with applicable laws to investigate illegal activities, suspected fraud, or potential threats to safety.

Payment Data

  • FeelyTalk processes payments securely, collecting only the necessary information to complete transactions, such as bank names or UPI confirmations.
  • Sensitive payment data like card numbers, PINs, or OTPs are not stored or accessed by FeelyTalk. Encryption protocols ensure the security of your payment details.

Limitations of Services

FeelyTalk does not provide access to emergency services such as medical, police, or fire departments. Users must ensure independent access to these services. FeelyTalk provides general discussions and guidance but is not a certified medical or professional advisory service.

Disclaimer

FeelyTalk provides its services on an “as is” basis without any express or implied warranties. We are not responsible for:

  • Errors, interruptions, or imperfections in the platform’s functionality.
  • User actions or the content shared by users or Listeners.
  • The outcomes of interactions between users and Listeners.

Indemnification

You agree to indemnify FeelyTalk, its employees, and directors against any claims, damages, or expenses arising from your use of the platform.

Governing Law and Dispute Resolution

  • All disputes shall be governed by the laws of India and fall under the exclusive jurisdiction of the courts in New Delhi, India.
  • Disputes will be resolved through arbitration, with arbitrators mutually agreed upon or appointed via FICCI. Arbitration fees will follow the Arbitration and Conciliation Act, 1996.

Acceptance of Terms

By downloading, installing, or using FeelyTalk, you confirm your acceptance of these Terms of Service. If you do not agree to these terms, please refrain from using the app.

Our Role and Limitations

  1. Listeners’ Role
    • FeelyTalk connects you with Listeners such as Professional Listeners, Happy Coaches, and Wellness Guides who aim to lend a listening ear and provide peer-level emotional support.
    • Listeners are not employees of FeelyTalk. They are independent associates vetted through basic due diligence. FeelyTalk does not guarantee the accuracy of any claims or credentials shared by the Listeners.
    • FeelyTalk encourages users to seek professional assistance (e.g., licensed therapists, medical professionals) for severe psychological, emotional, or physical issues.
  2. Disclaimer of Liability
    • FeelyTalk does not provide medical, psychological, or professional advice.
    • We are not responsible for any outcomes or consequences arising from your interactions with Listeners. This includes disputes, conflicts, or misunderstandings resulting from the discussions.
    • You agree to hold FeelyTalk harmless from any liabilities, damages, or claims stemming from your use of the app or your interactions with Listeners.
  3. Anonymity and Privacy
    • FeelyTalk prioritizes user anonymity. We strongly encourage you to refrain from sharing personal identifying information with Listeners.
    • Any association or communication outside the platform between users and Listeners is discouraged and done at your own risk.

User Conduct

By using FeelyTalk, you agree to:

  1. Respect the platform’s policies and maintain proper decorum during interactions.
  2. Avoid recording conversations or engaging in any activities (e.g., hacking, scraping, unauthorized data access) that violate the security or privacy of FeelyTalk.
  3. Be responsible for your actions and decisions, including sharing non-identifiable information during interactions.

Membership Services and Payment Terms

  1. Membership services may be available for a recurring fee.
  2. You agree to pay the applicable charges, including taxes, for any membership or services you enroll in.
  3. FeelyTalk does not offer refunds or price protection for promotional changes or discounts.

Changes to Services or Terms

  1. FeelyTalk reserves the right to:
    • Modify, suspend, or discontinue services without prior notice.

  • FeelyTalk shall not be liable for any damages, loss, or claims exceeding the total amount you have paid for membership services.
